Has anyone had any specific experience with Simply Natural, who are offering agri-investments in mango and lime farms in Panama. Legit or scam….?

Same here, 3 years, $500/year, $5K purchase price. And whatever fees there will be for sale, each pays his/her own.

I have been approached by David Clark. Offered $400 per year to lease and $4000 to purchase.
Does anyone have an opinion on this? When i have looked at agricultural land per hectare for sale in Panama this seems very low. Would like some feedback from others who have been approached.

Hi Inessa, if we need to pay for sale costs that will most likely cancel out any payment we receive for the hectare. It might be worth it for multiple hectares but not for only one.

That is my concern also, and beyond that, it’s 2 years of lease with no way out of sale. I posted reply to John with some info I got – please take a look and subscribe if you wish – I just did – and in any case ask Dusty to put you on his list of farm owners – he said in his last weekly that some info will be forthcoming.
Yeah in his weekly I read today he said: he is aware of something being offered to titled owners in SN Los Olivos. Not sure if he actually means David’s offer – I asked but he wouldn’t say, beyond that some info will be sent to farm owners mail list.
Regarding your comment, indeed it’s a question of what’s better – possibly in the future get a small fraction of what I invested (btw not even right away) – or just sit on the title and see if something better – or at least more immediate – will come from someone else.

Thanks Inessa. I have signed up to the newsletter.
I have declined David’s offer for now as it just isn’t worth the cost expense for the miniscule return!
I find the huge variation in rental and sale price per hectare that he has offered really strange and have told him so. He says it is to do with water supply, fire damage and maturity of trees.
I had a quick scan on farmland real estate in Panama and the price per hectare is significantly higher than even the highest offer. Obviously there will be regional variation .

yes, I haven’t accepted his offer either. I figure I’d at least hear what Dusty has to say.
But even without him saying anything definite, I don’t know that I would accept the offer. I just pity the trees – they may not at all survive the dry season.

I think when David first started making offers he was offering a fair price. But now all his offers are low ball – he thinks anyone with a title will assume they have no other options and sell to him. The fair value for the land is about 15-20 K per HA. However, if David can get 100 HA put together he can sell it for a nice return.
Currently, a fellow farm owner is attempting to get in touch with others to band together and sell the land for what it is worth. contact dusty@dcglobalconsultingllc.com and ask to join the SN newsletter let him know if you own titled land and where.

Bill, the reference you make to 15-20k per hectare is wrong…..I have just looked back in the thread and the particular message related to 2 hectares ie $ 7500-10,000 hectare. I am assuming that you know the costs of fertiliser, paying off the workers to access the lots, re installing irrigation systems against a back drop of these trees potentially not recovering.
My logic has remained consistent as has the price I offer, I am happy to talk it through and add my reasoning because each 1 hectare lot is different from the next.

I wrote to david clark giving him info on both my mangoes and avocadoes. I provided him title info on the avocadoes and told him I had never received title to the mangoes. He wrote back saying he could find no info on the mango title. I had already said I had no title to the mangoes. He seems a little confused on things. I have written to him again, but have not heard back yet.

Hello rjacobs, I am sorry the news you received from me was disappointing, this seem to be a continuing theme at the moment with most of my efforts…… the title deed search is simply for title deeds and is not specific to Mangoes, Limes , Avocados or anything else.
I am so sorry but that was the only deed and unless you have evidence to the contrary then that is all you have. Once again sorry and best wishes.

Any update on the lands that owned by Simply Natural?. I understand that they are no longer in business and banks are foreclosing on them?. Is this true?. What happens to all the people that invested and have titles for some of this land?.

I don’t know about bank foreclosure, but the various corporations associated with SN no longer exist. Those who have titles may be able to sell their land, but the number of buyers out there is extremely limited since many hectares are landlocked. Those who had greenhouse contracts are SOL… those contracts are worthless. The best you can do is take a tax write-off. If you owned your investment through an IRA or 401(k), contact your administrator to find out what documentation you need to demonstrate a devaluation. My Panama attorney is working on putting together a letter that documents the fact that SN is no longer in business, so that I can provide that to my IRA administrator.

Thank you for responding. It is very disheartening. I hoped that there is some salvage value that can be realized from these farms. There is no clear picture of what’s happening. If some people has titles to the parts of these farms, not sure how they are holding the title (on their personal name or part of simply natural corporation or individual corporation) and if they are free and clear without any liens.

Thank you David. It might be good for everyone on this thread to know your findings. People who received the titles, how did they receive?. On their personal name or in a corporation of their own or a share of the simply naturals one of 30 some corporations?. I understand that banks are involved in salvaging simply natural assets. What kind of liens these banks have against these properties?. If it is okay, please share your findings with this group. It might be useful for everyone to make future decisions.

Hi Surar, I am more than happy to reply to the group….The administration of the titling process was carried out by the legal agents 360 Consulting Group, a group of lawyers working on behalf of SN and its of associated companies. Where the title was passed to the individual purchasing the lot, he or she could have that title held in their own name, a corporation, LLC, Self Directed IRA . Where title was not passed by definition the current title and ownership of that land remains in the name of SN or their associated companies. There is one bank in particular, Global Bank who have a substantial loan outstanding , a number of creditors, some workers and other parties who have engaged lawyers to serve sequestration orders with the courts, the list of fincas (farms) specifically listed is extensive and I believe includes all the land still in the name of SN and its associated companies.

Thank you David for adding some clarity.

It is my experience that each farm in Panama has a finca number, folio number etc.. This is the way they identify each finca in the public registry and it reflects the ownership along with liens. The owners that received the title have finca number associated with each lot with survey and access to the finca?. When irrigation etc is for the total finca, how individual owners get access to the irrigation system when it does not belong to them?.

To solve a problem, first we need to clearly understand the problem. Once everyone understand what is going on clearly, it is possible to find the right solution.

So David where is the Title on my one Hectar in the avocado farm? All I have been received from Paulette in the past and after that it takes time and it was processed but as of today I have never received anything in regards.

Hello Kaz, you and many others have not received the title that you purchased, therefore by definition “your lot” remains in the name of SN or an associated company as far as the public land registry (ANATI) in Panama is concerned. All land in the name of SN or associated companies is now part of the sequestration orders lodged with the Panamanian courts, these orders make no allowance of those “owners” who did not receive title deeds

I ‘own’ (LOL) a greenhouse (traded in one of my lots) and signed papers to that effect in early 2023, but I don’t believe the trade was ever fully executed as Paulette and Alan left right after I submitted those forms and I never got anything back. So, based on reading through all this, does this mean, essentially, that I am SOL? I never received title to the original lot I purchased (that I know of) and there is no greenhouse to own, and no fully executed agreement even if there were a greenhouse. If I truly am SOL, what would you recommend I do? Is there an attorney in Panama who could advise? I continue to pay trust fees (and LLC fees) on this investment but would prefer to write it off and be rid of it if there’s no hope or legal recourse. My husband also owns lots but has title, which I think is a good thing? I admit to being very out of touch on this entire thing.

I am sorry but in my opinion there is little hope of legal recourse or redress, the farms were abandoned in Oct 2022. The greenhouses in late 2022 were systematically dismantled, cutting the supports 3 inches above the ground and sold for scrap metal. If you husband has titled lots I will happily walk the site and take a video, identify the lot and give a summary of the condition……we can then discuss options of perhaps rescuing something from this situation. Thanks, David. I will discuss with him. I believe my trust co. requires me to provide some kind of document stating that the investment is now of zero value for them to remove it from my account. Is this something that anyone else has done (that you know of?)

One can register and check the status of their property on this website. Hopefully this will give clarity to people who has title to the finca. You can see ownership details along with other details.
